Please read these terms carefully before booking a charter with Sapphire Sea. By completing a reservation, you agree to be bound by the following terms and conditions.

1. Reservations & Booking

All charters must be reserved in advance. A completed booking form and deposit payment are required to confirm your reservation. Bookings are subject to availability and are not confirmed until you receive a written confirmation from Salty Escapes Bahamas.

Reservations require a minimum of 48 hours' notice prior to the scheduled departure. Same-day bookings may be accommodated at the sole discretion of the operator and are not guaranteed.

By completing a booking, the lead guest ("Charter Guest") agrees to these Terms and Conditions on behalf of all passengers in the group.

2. Payment Terms

A non-refundable deposit is required at the time of booking to secure your charter date. The remaining balance is due no later than 24 hours before departure unless otherwise agreed in writing.

Accepted payment methods include all major credit and debit cards (Visa, Mastercard, American Express, Discover) and Google Pay. All transactions are processed securely through Stripe. Prices are listed in US Dollars (USD) and are subject to change without notice for future bookings.

Failure to complete payment by the due date may result in automatic cancellation of the reservation.

3. Cancellation & Refund Policy

Cancellations made more than 72 hours before the scheduled departure are eligible for a full refund of any amounts paid beyond the deposit. The deposit is non-refundable under all circumstances.

Cancellations made within 72 hours of the scheduled departure are non-refundable in full, including any balance payments made.

No-shows on the day of departure will be charged the full charter amount with no refund issued.

To cancel or modify a reservation, the Charter Guest must notify Salty Escapes Bahamas in writing via email at info@saltyescapesbahamas.com. Cancellations are effective upon written confirmation from our team.

4. Weather & Captain's Discretion

The safety of all passengers is our highest priority. Salty Escapes Bahamas reserves the right to cancel, delay, or modify any charter at any time due to weather conditions, mechanical issues, or any other circumstance deemed unsafe at the sole discretion of the Captain.

In the event of a weather-related cancellation initiated by Salty Escapes Bahamas, Charter Guests will be offered the choice of a full refund or a rescheduled charter at no additional cost.

Charters cancelled by the Charter Guest due to personal concerns about weather — when conditions are deemed safe by the Captain — are subject to the standard cancellation policy outlined in Section 3.

Wind, rain, or overcast skies alone do not constitute an unsafe condition. The Captain's decision is final.

5. Capacity & Guest Requirements

Each charter vessel has a maximum passenger capacity established by the U.S. Coast Guard and Bahamian Maritime Authority. Under no circumstances may the number of passengers exceed the posted limit. Salty Escapes Bahamas reserves the right to refuse boarding to any guest whose presence would exceed the vessel's legal capacity.

All passengers are required to be present at the designated departure location at least 15 minutes before the scheduled departure time. Late arrivals may result in a shortened charter or departure without the late party, with no refund issued for lost time.

Children under 12 years of age must wear a Coast Guard-approved personal flotation device (PFD) at all times while on deck. PFDs in various sizes are available aboard at no charge.

6. Health & Safety

All passengers participate in charter activities at their own risk. Salty Escapes Bahamas strongly recommends that guests disclose any medical conditions, disabilities, or allergies that may affect their safety or the safety of others aboard, prior to departure.

Guests are responsible for their own prescription medications and any seasickness remedies they may require. Salty Escapes Bahamas is not liable for illness or discomfort resulting from sea conditions.

Guests who appear to be under the influence of drugs or alcohol at the time of boarding may be refused embarkation without refund. The Captain reserves the right to end a charter early and return to port if a guest's behavior poses a risk to the safety of others.

7. Alcohol & Prohibited Items

Guests are welcome to bring their own alcoholic beverages aboard. Salty Escapes Bahamas does not sell or serve alcohol. All guests are expected to drink responsibly. The Captain reserves the right to confiscate alcohol and/or return to port early if intoxicated behavior creates an unsafe environment.

The following items are strictly prohibited aboard all vessels: - Illegal drugs or controlled substances - Glass containers on deck - Fireworks, flares, or open flames - Personal firearms or weapons - Animals, unless pre-approved in writing

Violations may result in immediate termination of the charter without refund.

8. Damage & Liability

The Charter Guest assumes full financial responsibility for any damage to the vessel, equipment, or property caused by themselves or any member of their party during the charter. This includes but is not limited to: damage to upholstery, electronic equipment, hull, or safety equipment.

Salty Escapes Bahamas carries commercial marine liability insurance. However, this does not cover personal belongings of guests. Guests are encouraged to leave valuables at home or secured ashore. Salty Escapes Bahamas is not responsible for lost, stolen, or damaged personal property.

Guests who cause damage will be invoiced for the full cost of repair or replacement at market rates.

9. Captain's Authority

The Captain of the vessel has absolute authority over all decisions related to the operation and navigation of the vessel, including route modifications, activity limitations, and early return to port. The Captain's decisions regarding safety are final and non-negotiable.

Charter Guests agree to follow all instructions given by the Captain and crew at all times. Failure to comply may result in the immediate termination of the charter without refund.

10. Itinerary Modifications

Salty Escapes Bahamas will make every reasonable effort to fulfill the advertised itinerary for each charter package. However, itineraries are subject to change due to weather, sea conditions, mechanical issues, or other circumstances beyond our control.

In the event of an itinerary modification, alternative destinations of comparable quality will be offered. No refunds will be issued solely on the basis of itinerary changes made for safety or operational reasons.

11. Photography & Media

By participating in a Salty Escapes Bahamas charter, guests grant permission for photographs and videos taken during the trip to be used for marketing and promotional purposes across our website and social media channels, unless the Charter Guest submits a written opt-out request prior to departure.

Guests retain ownership of any photographs or videos they personally capture during the charter.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Salty Escapes Bahamas, its officers, employees, agents, and crew shall not be liable for any indirect, incidental, special, or consequential damages arising from participation in any charter, including but not limited to personal injury, illness, property damage, or loss of enjoyment.

Total liability of Salty Escapes Bahamas for any claim arising out of or relating to a charter shall not exceed the total amount paid by the Charter Guest for the affected booking.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of the Bahamas and applicable maritime law. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Bahamas.

These Terms and Conditions constitute the entire agreement between Salty Escapes Bahamas and the Charter Guest regarding the subject matter herein and supersede all prior agreements, written or oral.
